It is a very difficult matter. The big question is: "Is a picture, which has been published in a public area of the internet, still covered by the copyright or is it reasonable to regard the picture as public domain?" Copyright means that a picture must not be copied in any way - neither by photo copying, photographically or electronically. You are not even allowed to save the picture on your hard disk (OMP has tried to prevent this) so we are all lawbreakers, and what good is a law, which everybody breaks? In my wildest imagination I cannot believe that anybody can be so naive as to think that if a picture has been published on the Internet and spread out over the whole world it will not be copied, and I don't think that any court will take up such a copyright case. In the same way, if you leave money on a table in a public place and it is stolen it is simple theft and you will not get anything from the insurance.
Unfortunately we miss an international Internet law, but it is probably reasonable to say that: 1) Any material, to which a license or a subscription is required (member pages, TV-programs etc.), must only be copied and used by the license holders or the subscribers - not by anyone else. Typically, the license or subscriber agreement gives you the permission to copy the material for your own use. Note that without such a permission you are not allowed to do that! 2) You are not allowed to sell any material unless you have the written permission from the original producer or copyright holder. 3) Material, which has been published for free in a public area of the Internet, is a gray zone. From a strictly juridical point of view it is probably still copyrighted, but in practice it may be regarded as public domain.
All wetlook producers have a problem. If they don’t show any pictures they will not get any members. If they do, the pictures will spread out over the Internet. There are several ways to deal with this problem. The pictures may be shown in a low resolution or with a watermark, but to try to enforce copyright laws for material, which has been published for free in a public area of the Internet, is to my opinion ridiculous. I think that for a wetlook producer the best solution is probably to put his web address on the pictures in a place where it do not destroy the pictures too much, but at the same time is very difficult to remove (transparent, no sharp edges etc.). In this way, their business card will spread out over the world. I have visited a lot of sites, where I have found the web-address on the pictures.

I'm pretty sure you have not found the images in your blog or at your imagecash galleries, did you? For me it looks more like you publish pictures - mostly without knowledge or permisson of the original source. I suggest you re-think your find-policy and only publish links to found images. |
